- Nutritional information is approximate and may vary by batch
- Flavors and ingredients are subject to change
2.2 Product Availability
- All products are subject to availability
- We reserve the right to limit quantities
- We may discontinue products without notice
- Out-of-stock items will be communicated before order confirmation
2.3 Age Restriction
Kombucha contains trace amounts of naturally occurring alcohol (typically <0.5% ABV from fermentation). By purchasing, you confirm you are 18+ years old.
2.4 FSSAI Compliance
All Fizzify products are manufactured in FSSAI-licensed facilities and comply with Food Safety and Standards Act, 2006.
3. Pricing & Payment
3.1 Pricing
- All prices are listed in Indian Rupees (INR)
- Prices include applicable GST
- Shipping charges are additional (unless free shipping applies)
- Prices are subject to change without notice
- The price at the time of order placement applies
3.2 Payment Methods
We accept:
- Credit Cards (Visa, Mastercard, American Express)
- Debit Cards (Visa, Mastercard, RuPay)
- UPI (Google Pay, PhonePe, Paytm)
- Net Banking
- Digital Wallets (Paytm, Mobikwik, etc.)
- Cash on Delivery (COD) – where available
3.3 Payment Security
- All payments are processed through secure, PCI-DSS compliant payment gateways
- We do NOT store your complete card details
- Payment information is encrypted using SSL technology
3.4 Payment Confirmation
- Orders are confirmed only after successful payment verification
- You will receive an order confirmation email
- COD orders may require phone verification
3.5 Failed Transactions
If payment fails:
- Amount will be refunded to source account within 5-7 business days
- Please retry order placement
- Contact support if amount is debited but order not confirmed

4.2 Order Confirmation
- Order confirmation email will be sent to your registered email
- Confirmation does not guarantee product availability
- We reserve the right to cancel orders due to:
- Product unavailability
- Pricing errors
- Payment issues
- Delivery address issues
- Suspected fraud
4.3 Order Modifications
- Orders can be modified within 1 hour of placement
- Contact customer support immediately
- We cannot guarantee modification success if order is already processed

5. Delivery Terms

5.1 Delivery Areas
- Currently delivering across Delhi NCR
- Pan-India shipping available (delivery times may vary)
- Some remote areas may not be serviceable
5.2 Delivery Time
- Standard Delivery: 2-5 business days (Delhi NCR)
- Metro Cities: 3-7 business days
- Other Cities: 5-10 business days
- Delivery times are estimates and not guaranteed
5.3 Delivery Charges
- Free delivery on orders above ₹500 (Delhi NCR)
- Flat ₹100 for orders below ₹500
- Shipping charges displayed at checkout
5.4 Delivery Partner
Orders are fulfilled by third-party logistics partners (Delhivery, Blue Dart, etc.)
6. Product Quality & Food Safety
6.1 Storage & Handling
Fizzify kombucha is a live, fermented beverage:
- Store refrigerated (2-8°C) after delivery
- Consume within best-before date
- Slight carbonation variation is normal
- Live cultures may create sediment (this is natural and safe)
6.2 Quality Assurance
- All products undergo quality checks before dispatch
- Manufacturing date and best-before date are clearly marked
- If you receive damaged or defective products, see Section 8 (Returns)
6.3 Health & Safety
- Kombucha is generally safe for most people
- Consult a doctor if you have specific health conditions
- Not recommended for pregnant/breastfeeding women without medical advice
- Contains trace alcohol from natural fermentation
7. Cancellation Policy
7.1 Cancellation by Customer
Before Dispatch:
- You can cancel anytime before order is shipped
- Full refund will be processed

After Dispatch:
- Cancellation not possible once shipped
- You may refuse delivery (return shipping charges apply)
- Or accept and request return (see Returns Policy)
7.2 Cancellation by Fizzify
We may cancel orders due to:
- Product unavailability
- Unserviceable delivery location
- Pricing or technical errors
- Suspected fraudulent activity
- Force majeure events
In case of cancellation by us:
- Full refund within 5-7 business days
- Email notification sent
- No cancellation charges
8. Returns, Refunds & Replacement

8.1 Return Eligibility
Returns accepted for:
- Damaged products
- Defective/leaking cans
- Wrong product delivered
- Expired products
- Quality issues
8.2 Return Timeline
- Report issues within 48 hours of delivery
- Return request must be initiated within 2 days
8.3 Non-Returnable Items
- Products consumed or opened (unless quality issue)
- Products without original packaging
- Products past best-before date due to customer storage
8.4 Refund Processing
- Refunds processed within 7-10 business days after return approval
- Refund to original payment method
9. Intellectual Property
9.1 Trademarks
- “Fizzify” name, logo, and branding are trademarks of Fizzify Beverages Pvt. Ltd.
- Product names (“Berry Over It,” “Peach Please,” “Passion Punch”) are our intellectual property
- Unauthorized use is prohibited
9.2 Website Content
- All content (text, images, videos, graphics) is owned by Fizzify
- You may not copy, reproduce, or distribute without written permission
- Product reviews and user-generated content may be used by Fizzify for marketing
9.3 License
We grant you a limited, non-exclusive, non-transferable license to access and use the website for personal, non-commercial purposes.
10. User Accounts
10.1 Account Creation
- You must provide accurate information
- Keep your password secure
- You are responsible for all account activity
- Do not share account credentials

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

12.2 Liability Cap
Our total liability for any claim shall not exceed the amount you paid for the specific product or ₹1,000, whichever is lower.

- Indirect, incidental, or consequential damages

- Third-party actions (delivery partners, payment gateways)
- Force majeure events (natural disasters, strikes, pandemics, etc.)
12.4 Consumer Rights
Nothing in these Terms limits your statutory rights under Indian consumer protection laws.
13. Indemnification
You agree to indemnify and hold harmless Fizzify Beverages Pvt. Ltd., its directors, employees, and agents from any claims, damages, or losses arising from:
- Your violation of these Terms
- Your use of the website
- Your violation of any third-party rights
- Fraudulent activity from your account
14. Privacy & Data Protection
Your personal information is governed by our Privacy Policy. By using this website, you consent to our data practices as described in the Privacy Policy.

15. Dispute Resolution

15.2 Arbitration
If informal resolution fails, disputes shall be resolved through binding arbitration in Aligarh, Uttar Pradesh, under the Arbitration and Conciliation Act, 1996.
15.3 Governing Law
These Terms are governed by the laws of India. Courts in Aligarh, Uttar Pradesh have exclusive jurisdiction.
15.4 Consumer Forums
Nothing prevents you from approaching consumer forums under the Consumer Protection Act, 2019.
16. Force Majeure
We are not liable for delays or failures due to events beyond our reasonable control, including:
- Natural disasters (floods, earthquakes, pandemics)
- Government actions or regulations
- Strikes or labor disputes
- Wars or terrorism
- Internet or telecommunications failures
- Supplier or logistics disruptions
17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force.
18. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Returns Policy, constitute the entire agreement between you and Fizzify.
